U.S. judge grants access to new evidence in Aafia Siddiqui case

Washington, October 10, 2024– A U.S. District Judge, Richard M. Berman, has approved a request from Dr. Aafia Siddiqui’s legal team to access confidential evidence that could strengthen their clemency petition. The ruling permits her attorneys to review critical discovery materials from 2009, though access remains restricted due to national security concerns.

Clive Stafford Smith, one of Siddiqui’s attorneys, expressed optimism about the newly revealed evidence, particularly regarding her alleged detention at a “Black Site” following her isolation at Bagram Air Base. He has also submitted a 56,600-word clemency petition that details the complexities and alleged injustices surrounding Siddiqui’s case.

The motion, based on a federal statute, enables inmates to challenge their convictions on grounds such as constitutional violations and jurisdictional issues. It functions as a post-conviction remedy, akin to a federal habeas corpus petition, and includes provisions that allow for sentence reductions in extraordinary circumstances, such as serious health conditions.
