Islamabad, September 8, 2024- Constitutional expert Hafiz Ehsaan Ahmad has analyzed the Supreme Court’s recent decision, which overturned a previous ruling from September 15, 2023, concerning NAB amendments and parliamentary authority. This decision impacts public office holders and related cases from January 1985 onwards.

Key points include

  • Amendments to the NAB Ordinance had previously excluded certain officials from NAB scrutiny and set a minimum threshold of Rs 500 million for corruption cases.
  •  The Supreme Court’s September 6 ruling confirms these amendments, meaning NAB can no longer investigate cases below this threshold or involving certain decisions. Ongoing cases may be redirected based on these changes.
  •  For the Toshakhana cases involving former Prime Minister Imran Khan, if the cases fall below the monetary threshold, they will be either returned to NAB or transferred to the appropriate court.
  • The 190 million pounds case against the former Prime Minister will continue unless proven otherwise by the defense, based on the new amendments.

In summary, the recent ruling affects how NAB handles ongoing and future cases, with significant implications for public office holders and the legal process.
