Judicial seniority dispute:5 IHC judges challenge transfers in SC

Islamabad, February 20, 2025: A significant judicial controversy has emerged as five judges of the Islamabad High Court (IHC) have moved the Supreme Court against the seniority list, challenging recent transfers.

Justices Mohsin Akhtar Kayani, Tariq Mahmood Jahangiri, Babar Sattar, Sardar Ejaz Ishaq Khan, and Saman Rafat Imtiaz have filed a 49-page petition under Article 184(3) through senior legal counsel Munir A. Malik and Barrister Salahuddin. The petition questions the president’s authority under Article 200(1) to transfer judges arbitrarily between high courts, arguing that such decisions must be justified by public interest.

The judges have urged the Supreme Court to suspend the transferred judges and prevent Justice Sarfraz Dogar from serving as acting chief justice. Notably, former IHC Chief Justice Aamer Farooq had earlier dismissed their seniority representation.
