Reserved seats case- majority judges issue second clarification

Islamabad, October 18,2024- Eight Supreme Court judges, who delivered the majority ruling in the case on reserved seats, have issued a second clarification. The clarification was provided in response to a request from the Election Commission, stating that the amendments to the Election Act do not nullify the July 12 decision. The court clarified that the amendments, even if applied retroactively, cannot undermine the previous ruling.

The Supreme Court noted that hearings were held in chambers in both Karachi and Islamabad regarding this matter. The right to seek clarification was granted to ensure smooth implementation of the interim order, but now that a detailed judgment has been issued, no further clarification is needed.

The majority judges explained that all legal and constitutional aspects have been thoroughly addressed in the detailed decision. They had already provided clarification before the detailed reasons were issued, and the first clarification was incorporated into the final judgment. The judges emphasized that seeking clarification was a temporary provision until the detailed reasons were made available.

The judges reiterated that all legal issues raised by the parties have been fully addressed, and no further clarification is necessary. Under Article 189 of the Constitution, the court’s decision is binding and should have been enforced without delay.
